If we do not reach an agreed settlement in mediation, another alternative is to go to appraisal, if your policy has that option.  Unfortunately, sometimes it is necessary to file suit against your insurance company to achieve the results the insured is entitled to.

The Appraisal Process

Unlike the Mediation process that is required in all Florida Property policies, the Appraisal process is not mandated by the State. Not all insurance companies offer this option in their policy and some policies directly state either Mediation or Appraisal. If the Appraisal option is in your policy you are not required to go to Mediation, you can opt to go straight to Appraisal. However, Mediation does not cost you anything and we have the opportunity to properly present your claim to the insurance company at that meeting.  This applies to both commercial and residential property insurance.

What is the Appraisal Provision?

It is a way of settling a claim that is between Mediation and Litigation. Unlike Mediation where the Insurance Company is required to pay the cost of Mediation, the cost for Appraisal is split between the insured and the insurance company. As your public adjuster we would represent you as your appraiser as part of our service. However, if we could not come to an agreement for settlement of the claim one half the cost of an impartial Umpire is paid by the homeowner. The cost of an umpire is based on the size and complexity of the claim. Typically, the cost to the homeowner would range from $500 to $1,200. For the claim to be settled however, only one appraiser in addition to the umpire must agree on the settlement amount, which is binding.

The Benefit of Going to Appraisal

The appraisal option is much faster than litigation. It is usually a maximum of 30-45 days; whereas most attorneys will tell you that litigation can take anywhere from 2 months to 2 years or longer. It is also less expensive than Litigation. In Florida if you file suit against your insurance company and you win, the insurance company is required to pay your attorney fees. However, if the suit is settled prior to an actual trial, they are not required to do so. Sometimes your attorney can negotiate with the insurance company to cover their fees; but there is no guarantee that will happen. If the appraisal process is provided in your policy it can be an effective way to settle your claim.

The disadvantage of the appraisal process is that if we do not win in appraisal there are only very limited circumstances that would allow you to file suit at a later date. However, there is also a disadvantage to a law suit – you may not win. We are very selective in regard to the people we represent. We will not take a claim that we feel cannot be won or is of a fraudulent nature.
